Houston Lawyer Files Motion for Prosecutors to be Removed from Twin Peaks Cases

Today, on the one-year anniversary of the deadly Twin Peaks shooting, a Houston-based Attorney has filed a motion in Waco’s 54th state district court to disqualify any prosecutors in the cases relating to the May 17th shooting.

Abigail Anastasio is representing Ray Nelson, one of the nearly 160 bikers that have been indicted so far. Anastasio says prosecutors, like District Attorney Abel Reyna, went beyond their role and authority.

“There’s a difference between advising and commandeering and that’s what happened in this case", Anastasio said, outside the McLennan County courthouse.  

Anastasio’s motion claims Reyna and other prosecutors “changed the scope and course of the investigation”. Their role, Anastasio says, makes them potential witnesses.

“They, and only, they, are competent to speak of what decisions were made in directing the investigation in this case, because they were the ones who made those decisions and directed the actions of the officers at the scene.”

There’s no date for the motion to be hear.
