Texas Court of Criminal Appeals Lifts Twin Peaks Shooting Gag Order

Today the Texas Court of Criminal Appeals removed the gag order issued last year in the case of a biker arrested in the Twin Peaks shooting.

In a unanimous decision the court said they “deny mandamus relief and withdraw our order staying the proceedings.”

The opinion upholds an earlier ruling from the 10th court of appeals that originally overturned the gag order last august. Shortly after the ruling, however, District Attorney Abel Reyna sought the CCA’s ruling, which allowed the gag order to remain in effect until an opinion was reached today.

“The Gag Order was requested by the State to help preserve and maintain everyone’s right to a fair trial," Reyna said in a statement. 

Last June, a county Judge placed the gag order after Reyna’s office. The request came as an attorney for the biker Matthew Clendennan sought the release of surveillance video. 

Clendenan was one of the 177 bikers arrested in the aftermath of the Twin Peaks shooting that left 9 dead and more than 20 injured.
